Terms of Donation

These Terms of Donation (the “Donation Terms”) apply to one-time charitable donations made to Patriots Care Fund (“Patriots Care Fund,” “PCF,” “we,” “us,” or “our”) through our Website. By making a one-time donation, you agree to these Donation Terms, our Terms and Conditions, and our Privacy Policy. Recurring monthly gifts are governed by our separate Recurring Donation Pledge Agreement.

1. Making a Donation

When you make a one-time donation, you may select a preset amount of US$20, US$50, US$100, US$200, or US$500, or you may enter a custom amount. To complete your donation, you will be asked to provide your first name, last name, email address, phone number, and mailing address (street address, city, state, and ZIP code), and to confirm your agreement to these Donation Terms.

2. Payment Processing

Donations are processed through our donation platform, Donorbox, which uses Stripe to handle card payments. When you submit your donation, you will be directed to complete payment through Donorbox. Patriots Care Fund does not collect or store your full payment-card number. All card payments are subject to the Donorbox and Stripe terms and privacy policies. For each successful donation, we record the date and time of the transaction, the IP address used, the Donorbox or Stripe receipt number, and your name and email address, as described in our Privacy Policy.

3. Your Authorization

By submitting a donation, you represent and warrant that you are authorized to use the payment method provided and that the funds are yours to donate. You authorize the charge of the amount you select to that payment method.

4. Tax-Exempt Status and Deductibility

Patriots Care Fund is recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code. Our Employer Identification Number (EIN) is 41-4206283. To the extent permitted by law, your donation may be tax-deductible. No goods or services are provided in exchange for your donation unless we expressly state otherwise. We recommend that you consult your tax advisor regarding the deductibility of your contribution. We will provide a written acknowledgment (receipt) by email for your donation; for any single donation of US$250 or more, this acknowledgment is intended to meet IRS substantiation requirements.

5. Receipts and Acknowledgment

After a successful donation, you will receive an email confirmation that serves as your receipt. Please retain it for your records and tax purposes.

6. Use of Funds

Unless we agree otherwise in writing, donations are unrestricted and will be applied to the general charitable purposes of Patriots Care Fund at our discretion. If a donation is designated for a specific purpose that we are unable to fulfill, we may apply the funds to a similar purpose consistent with our mission.

7. Refund Policy

All donations to Patriots Care Fund are final. Because your contribution is directed to our charitable mission upon receipt, donations are non-refundable, except in the limited cases of a clear processing error (such as a duplicate charge or an incorrect amount) or an unauthorized transaction. If you believe one of these has occurred, please contact us at patriotscarefund@gmail.com within 15 days of the transaction, and we will review the request in good faith. Where a refund is approved, it will be returned to the original payment method.

8. Chargebacks

If you have a concern about a donation, please contact us before initiating a chargeback with your bank or card issuer so that we can try to resolve the matter directly.

9. Currency

All donations are processed in U.S. dollars (USD) unless otherwise indicated.

10. Changes to These Donation Terms

We may update these Donation Terms from time to time. The version in effect at the time of your donation governs that donation. Updated terms will be posted on the Website with a revised Effective Date.

Governing Law and Disputes

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these terms or your use of the Website will be subject to the exclusive jurisdiction of the state and federal courts located in the State of Colorado.
