Recurring Donation Pledge Agreement

This Recurring Donation Pledge Agreement (the “Agreement”) governs recurring monthly donations (each, a “Pledge”) that you authorize to Patriots Care Fund (“Patriots Care Fund,” “PCF,” “we,” “us,” or “our”) through our Website. By selecting a monthly pledge and confirming your agreement, you authorize the recurring charges described below. This Agreement supplements our Terms and Conditions and Privacy Policy.

1. Your Pledge

Your Pledge is a recurring charitable donation in the monthly amount you select at sign-up (a preset amount or a custom amount). Your selected amount will be charged to your payment method on a recurring monthly basis until you change or cancel your Pledge.

2. Authorization for Recurring Charges

You authorize Patriots Care Fund and its donation platform, Donorbox (which processes payments through Stripe), to automatically charge your selected payment method the Pledge amount on a recurring monthly basis. Your first charge occurs at the time you set up your Pledge, and subsequent charges occur on approximately the same day of each month thereafter. This is an ongoing authorization that remains in effect until you cancel your Pledge or it is terminated as described in this Agreement.

3. Billing Amount and Date

Your Pledge will be charged monthly in the amount you selected. The amount will remain the same each month unless you change it or we notify you of a change in accordance with this Agreement. If your billing day does not exist in a given month, the charge may be processed on the last day of that month or the next available day.

4. Payment Method and Processing

Recurring charges are processed through Donorbox using Stripe. Your payment details are stored and managed securely by Donorbox and Stripe, not by Patriots Care Fund, and are subject to their terms and privacy policies. You are responsible for keeping your payment information current. To update your payment information, email us at patriotscarefund@gmail.com and we will provide a secure way to do so. Please do not send full payment-card details by email.

5. Changing or Canceling Your Pledge

You may change the amount of your Pledge, or cancel it, at any time and without penalty by emailing us at patriotscarefund@gmail.com. Cancellation applies to future charges; please allow up to 3 business days for your request to take effect. Charges already processed before your cancellation are governed by the Refund Policy below.

6. Failed or Declined Payments

If a recurring charge is declined or fails, Donorbox or Stripe may automatically retry the charge, and we may contact you to update your payment information. If a charge cannot be completed after reasonable attempts, we may pause or cancel your Pledge.

7. Tax-Exempt Status and Deductibility

Patriots Care Fund is recognized as tax-exempt under Section 501(c)(3) of the Internal Revenue Code. Our Employer Identification Number (EIN) is 41-4206283. To the extent permitted by law, your recurring donations may be tax-deductible. No goods or services are provided in exchange for your Pledge unless we expressly state otherwise. We recommend that you consult your tax advisor. We will provide an email receipt for each successful charge, and can provide an annual giving statement summarizing your contributions on request.

8. Receipts

You will receive an email confirmation for each successful recurring charge. Please retain these confirmations for your records and tax purposes.

9. Refund Policy

Recurring charges are final and non-refundable, except in the limited cases of a clear processing error, an unauthorized charge, or a charge made after you have requested cancellation. If you believe one of these has occurred, please contact us at patriotscarefund@gmail.com within 15 days of the transaction, and we will review your request in good faith. This Refund Policy is consistent with our Terms of Donation.

10. Changes to This Agreement

We may update this Agreement from time to time. We will post the updated Agreement on the Website with a revised Effective Date and, where required, provide notice of material changes. If we change your Pledge amount or other material terms, your continued participation after the change takes effect constitutes acceptance; otherwise, you may cancel your Pledge as described above.

11. Use of Funds

Unless we agree otherwise in writing, recurring donations are unrestricted and will be applied to the general charitable purposes of Patriots Care Fund at our discretion.

Governing Law and Disputes

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these terms or your use of the Website will be subject to the exclusive jurisdiction of the state and federal courts located in the State of Colorado.
